This trademark infringement notice has been sent to you by CitizenHawk, Inc. (“CitizenHawk”), the leading provider of digital brand management solutions. This notice is sent on behalf of J.C. Penney Corporation, Inc. (“JCPenney”), for which we are acting as authorized agent.
Please be advised that JCPenney is the registered owner of numerous trademarks, including the following trademark: U.S. Reg. No. 2437229 for the mark “JCPENNEY” (“the Mark”). J.C. Penney Corporation, Inc. has invested considerable time and money in establishing proprietary rights in the JCPENNEY mark, as evidenced by its U.S. trademark registration. J.C. Penney Corporation, Inc. is, and has been, using the Mark continuously since January 1, 1990 and employs the Mark for online retail department store services.
It has come to our attention that you have registered the following domain name(s):
jcp-enney.com
It is apparent that you are trying to capitalize on J.C. Penny Corporations, Inc.’s rights in the Mark, including but not limited to, jcpenney.com, by using a confusingly similar domain name to divert traffic to your site. Your registration and use of a confusingly similar domain name infringes on J.C. Penney Corporation, Inc.’s rights because it creates a likelihood of confusion, mistake or deception among the public, who will believe that your services and/or goods are affiliated with, or endorsed by J.C. Penney Corporation, Inc. when, in fact, they are not. This type of misrepresentation is specifically banned by existing federal and state statutes, including the Anti –Cybersquatting Consumer Protection Act (ACPA), which also provides for statutory damages of up to $100,000 per infringing domain.
On behalf of J.C. Penney Corporation, Inc., we hereby demand that you immediately discontinue use of the domain name(s) and that you assign the domain name registration(s) to J.C. Penney Corporation, Inc.
Please respond to this email by February 16, 2012. The CitizenHawk domain recovery team, as agent for J.C. Penney Corporation, Inc., will work with you to help facilitate the domain transfer process.
J.C. Penney Corporation, Inc. considers this a serious matter and is prepared to take all appropriate legal action to protect its intellectual property rights.
