It has come to our attention that you are the registrant of record for the website that includes the page found at the Internet address:
http://www.мойшопpill.com/ and subsequent pages that appear to offer to sell to U.S. consumers versions of Genentech or Roche products which have not been approved by the U.S. Food and Drug Administration (FDA) or which appear to be available without a written prescription.
According to the Division of Import Operations and Policy at FDA, the interstate shipment and/or importation of unapproved new drugs is prohibited under U.S. federal law.
“Unapproved new drugs are any drugs, including foreign-made versions of U.S. approved drugs, that have not been manufactured in accordance with or pursuant to an FDA approval. . . . Absent evidence that the specific drugs sought to be imported from a foreign country/area have been manufactured pursuant to an approved new drug application, in the manufacturing facility permitted under the application, such drugs would appear to be unapproved drugs subject to FDA enforcement action. Under the U.S. Food, Drug and Cosmetic Act, FDA has the legal authority to take action against the importation, sale, or distribution of an unapproved new drug, as well as the sale or dispensing of a prescription drug without a valid prescription. Genentech, Inc., a member of the Roche Group, takes the sale of unapproved versions of its products seriously and works closely with U.S. government authorities help them in their efforts to prevent illegal activities. This collaboration includes periodic reporting to U.S. Customs and Border Patrol and the Office of Criminal Investigations at FDA of websites that appear to be offering to sell unapproved new drugs or drugs without a valid prescription to U.S. consumers.
If your website continues to offer these products to U.S. consumers in a manner that appears to violate U.S. law your website may be included in our next periodic report to U.S. government authorities. In addition, Genentech reserves the right to take any other legal action against your website that may be available under federal or state law.
